Nutzungsbedingungen – PlayMate

1. Geltungsbereich

Diese Nutzungsbedingungen regeln die Nutzung der App PlayMate auf iOS und Android. Mit der Registrierung und Nutzung der App erklärst du dich mit diesen Bedingungen einverstanden.

2. Voraussetzungen

• Mindestalter: 13 Jahre
• Nutzer unter 16 Jahren nutzen die App auf eigene Verantwortung (ggf. mit Zustimmung der Erziehungsberechtigten)
• Angaben müssen wahrheitsgemäß sein

3. Nutzerkonto

• Jeder Nutzer darf nur ein Konto erstellen
• Du bist für die Sicherheit deines Kontos selbst verantwortlich
• Bei Missbrauch behalten wir uns eine Sperrung oder Löschung vor

4. Inhalte & Verhalten (Null-Toleranz)

PlayMate beinhaltet nutzergenerierte Inhalte (z. B. Profile, Chats, Posts, Gruppen- & Eventinhalte). Es gilt Null-Toleranz gegenüber beleidigenden, belästigenden oder rechtswidrigen Inhalten.

Nicht erlaubt sind insbesondere (Beispiele):

• Hassrede, Diskriminierung, Gewaltandrohungen oder Aufrufe zu Gewalt
• Belästigung, Mobbing, Stalking oder sexuelle Belästigung
• Sexuelle Inhalte mit Minderjährigen, Ausbeutung oder Anbahnung (Grooming)
• Veröffentlichung fremder personenbezogener Daten ohne Einwilligung
• Illegale Inhalte, Spam, Betrug, Scams oder Identitätstäuschung

5. Melden, Blockieren & Moderation

• Melden: Nutzer können Inhalte und Nutzer direkt in der App melden.
• Blockieren: Nutzer können andere Nutzer blockieren; blockierte Nutzer sind sofort nicht mehr sichtbar/ansprechbar.
• Developer wird informiert: Meldungen/Blockierungen werden an uns übermittelt, damit wir Maßnahmen ergreifen können.
• Reaktionszeit: Gemeldete Inhalte werden geprüft und i. d. R. innerhalb von 24 Stunden bearbeitet (Entfernung/Sperre).

6. Events & Gruppen

• PlayMate dient der Vermittlung von Kontakten
• Wir übernehmen keine Haftung für reale Treffen, Events oder Gruppen
• Teilnahme erfolgt auf eigenes Risiko

7. In-App-Käufe & Abos

• Käufe erfolgen über Apple App Store oder Google Play Store
• Abrechnung, Verlängerung und Kündigung erfolgen über den jeweiligen Store
• Es gelten zusätzlich die Bedingungen von Apple und Google

8. Werbung

Die App kann Werbung enthalten, sofern kein werbefreies Abo aktiv ist.

9. Sperrung & Kündigung

Wir behalten uns vor, Nutzerkonten bei Verstößen gegen diese Bedingungen zu sperren oder zu löschen. Du kannst dein Konto jederzeit löschen.

10. Haftung

• Nutzung erfolgt auf eigenes Risiko
• Keine Garantie für ständige Verfügbarkeit
• Keine Haftung für Inhalte anderer Nutzer

11. Anwendbares Recht

Es gilt das Recht der Europäischen Union und – soweit anwendbar – das Recht Italiens.

I presenti termini di utilizzo disciplinano l’utilizzo dell’app PlayMate su iOS e Android. Registrandoti e utilizzando l’app, accetti i presenti termini.

2. Requisiti

• Età minima: 13 anni
• Gli utenti di età inferiore a 16 anni utilizzano l’app sotto la propria responsabilità (eventualmente con il consenso dei genitori o tutori)
• Le informazioni fornite devono essere veritiere

3. Account utente

• Ogni utente può creare un solo account
• Sei personalmente responsabile della sicurezza del tuo account
• In caso di abuso, ci riserviamo il diritto di sospendere o eliminare l’account

4. Contenuti & comportamento (tolleranza zero)

PlayMate include contenuti generati dagli utenti (ad es. profili, chat, post, contenuti di gruppi ed eventi). Si applica una politica di tolleranza zero nei confronti di contenuti offensivi, molesti o illeciti.

In particolare, non sono consentiti (esempi):

• Incitamento all’odio, discriminazione, minacce di violenza o istigazione alla violenza
• Molestie, bullismo, stalking o molestie sessuali
• Contenuti sessuali che coinvolgono minori, sfruttamento o adescamento (grooming)
• Pubblicazione di dati personali di terzi senza consenso
• Contenuti illegali, spam, frodi, truffe o impersonificazione

5. Segnalazione, blocco & moderazione

• Segnalazione: gli utenti possono segnalare contenuti e altri utenti direttamente nell’app.
• Blocco: gli utenti possono bloccare altri utenti; gli utenti bloccati non saranno più immediatamente visibili o contattabili.
• Lo sviluppatore viene informato: segnalazioni e blocchi ci vengono trasmessi affinché possiamo adottare misure adeguate.
• Tempo di reazione: i contenuti segnalati vengono esaminati e normalmente gestiti entro 24 ore (rimozione/sospensione).

6. Eventi & gruppi

• PlayMate serve a facilitare il contatto tra utenti
• Non ci assumiamo alcuna responsabilità per incontri reali, eventi o gruppi
• La partecipazione avviene a proprio rischio

7. Acquisti in-app & abbonamenti

• Gli acquisti vengono effettuati tramite Apple App Store o Google Play Store
• Fatturazione, rinnovo e cancellazione sono gestiti tramite il rispettivo store
• Si applicano inoltre i termini e le condizioni di Apple e Google

8. Pubblicità

L’app può contenere pubblicità, salvo che sia attivo un abbonamento senza pubblicità.

9. Sospensione & cessazione

Ci riserviamo il diritto di sospendere o eliminare gli account utente in caso di violazione dei presenti termini. Puoi eliminare il tuo account in qualsiasi momento.

10. Responsabilità

• L’utilizzo avviene a proprio rischio
• Nessuna garanzia di disponibilità continua
• Nessuna responsabilità per i contenuti di altri utenti

11. Legge applicabile

Si applica il diritto dell’Unione Europea e, ove applicabile, il diritto italiano.

These Terms of Use govern the use of the PlayMate app on iOS and Android. By registering for and using the app, you agree to these terms.

2. Requirements

• Minimum age: 13 years
• Users under the age of 16 use the app at their own responsibility (where applicable, with parental or guardian consent)
• All information provided must be truthful

3. User account

• Each user may create only one account
• You are responsible for the security of your account
• In cases of misuse, we reserve the right to suspend or delete the account

4. Content & conduct (zero tolerance)

PlayMate includes user-generated content (for example profiles, chats, posts, group content and event content). We apply a zero-tolerance policy toward abusive, harassing, or unlawful content.

The following are not permitted in particular (examples):

• Hate speech, discrimination, threats of violence, or incitement to violence
• Harassment, bullying, stalking, or sexual harassment
• Sexual content involving minors, exploitation, or grooming
• Publishing another person’s personal data without consent
• Illegal content, spam, fraud, scams, or impersonation

5. Reporting, blocking & moderation

• Reporting: users can report content and users directly in the app.
• Blocking: users can block other users; blocked users will immediately no longer be visible or reachable.
• Developer is informed: reports and blocks are transmitted to us so that we can take appropriate action.
• Response time: reported content is reviewed and generally processed within 24 hours (removal/suspension).

6. Events & groups

• PlayMate is intended to facilitate connections between users
• We assume no liability for in-person meetings, events, or groups
• Participation is at your own risk

7. In-app purchases & subscriptions

• Purchases are made through the Apple App Store or the Google Play Store
• Billing, renewal, and cancellation are handled through the respective store
• Apple’s and Google’s additional terms also apply

8. Advertising

The app may contain advertising unless an ad-free subscription is active.

9. Suspension & termination

We reserve the right to suspend or delete user accounts in the event of violations of these terms. You may delete your account at any time.

10. Liability

• Use is at your own risk
• No guarantee of continuous availability
• No liability for content provided by other users

11. Governing law

The law of the European Union and, where applicable, the law of Italy shall apply.
